1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BETMGM, LLC ("BetMGM," "we," "our," or "us") governing your access to and use of the BetMGM sportsbook platform, website, mobile application, and all related services (collectively, the "Platform"). By accessing, registering for, or using the Platform in any way, you unconditionally accept and agree to be bound by these Terms. If you do not agree with any provision of these Terms, you must immediately discontinue all use of the Platform.

2. Eligibility Requirements

You must meet all of the following requirements to use BetMGM: (a) you must be at least 21 years of age; (b) you must be physically located within a jurisdiction where BetMGM is licensed and authorized to operate at the time of placing any wager; (c) you must not be on any self-exclusion list in any jurisdiction; (d) you must not be an employee, contractor, or immediate family member of BETMGM, LLC, its affiliates, or any partner sports league; and (e) you must provide accurate and complete registration information, including valid government-issued identification for identity verification purposes. BetMGM reserves the right to request identity documentation at any time and to suspend or close accounts where eligibility cannot be verified.

3. Account Registration & Security

You are permitted to maintain only one active BetMGM account. Duplicate accounts are strictly prohibited and will result in immediate closure of all associated accounts, forfeiture of any promotional funds, and potential reporting to relevant gaming authorities. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. You must notify BetMGM immediately upon discovering any unauthorized use of your account. BetMGM will not be liable for any loss arising from your failure to safeguard your credentials.

4. Deposits, Withdrawals & Payment Processing

BetMGM accepts deposits via major credit and debit cards (Visa, Mastercard), PayPal, online banking transfer (ACH), Venmo, BetMGM Gift Cards, and cash at participating MGM retail locations. Minimum deposit amounts may apply. All funds must be deposited from accounts held in your own name. Third-party deposits are strictly prohibited. Withdrawal requests are processed subject to identity verification and wagering requirements. BetMGM reserves the right to conduct enhanced due diligence reviews on withdrawal requests exceeding threshold amounts as required by applicable anti-money laundering regulations.

5. Betting Rules & Wagering Conduct

All wagers are subject to BetMGM's House Rules, which are incorporated herein by reference. BetMGM reserves the right to void, suspend, or limit any wager where: (a) a pricing or technical error has occurred; (b) the event outcome is known at the time of wagering; (c) suspicious betting patterns or potential match manipulation is detected; or (d) the wager violates applicable laws or regulations. Maximum wager amounts vary by sport, market, and user account profile. BetMGM may at its sole discretion restrict or limit wagering activity on any account at any time without prior notice.

6. Promotions & Bonus Terms

All promotional offers, including welcome bonuses, first-bet offers, and ongoing promotions, are subject to individual promotion-specific terms and conditions, which supplement and take precedence over these general Terms to the extent of any conflict. Bonus Bets are non-withdrawable and non-transferable. Any winnings generated from Bonus Bets will be credited as real cash, withdrawable after meeting applicable requirements. BetMGM reserves the right to modify, suspend, or cancel any promotion at any time. Abuse of promotions, including through the use of multiple accounts, may result in disqualification and account closure.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BetMGM, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of or inability to use the Platform, including but not limited to loss of profits, loss of data, or service interruptions, even if BetMGM has been advised of the possibility of such damages. BetMGM's total liability to you for any claim shall not exceed the net deposits made by you in the 90 days preceding the event giving rise to such claim.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to a jury trial and agree that proceedings will be conducted on an individual basis and not as part of any class or representative action.

9. Responsible Gaming Compliance

BetMGM is committed to responsible gaming and complies with all state-mandated responsible gaming requirements. We provide tools including deposit limits, loss limits, session time limits, cooling-off periods, and self-exclusion options. We actively train our staff to identify and respond to signs of problem gambling. Information regarding responsible gaming resources is available at all times within the Platform and at betmgm.com/en/sports/responsible-gaming.

10. Modifications to Terms

BetMGM reserves the right to modify these Terms at any time. Material changes will be communicated via email notification to registered users and/or by prominent notice within the Platform. Your continued use of the Platform following the effective date of any modifications constitutes your acceptance of the revised Terms. You should review these Terms periodically to ensure your ongoing understanding and acceptance.

1. Information We Collect

BETMGM, LLC collects information necessary to provide our sports wagering services and comply with legal obligations. This includes: Identity Information (full legal name, date of birth, Social Security Number for identity and age verification as required by state gaming regulations, government-issued ID); Contact Information (email address, phone number, mailing address); Financial Information (bank account details, payment card information, deposit and withdrawal history, wagering transaction records); Device & Technical Information (IP address, geolocation data required to confirm you are within a licensed jurisdiction, device identifiers, browser type, operating system); and Behavioral Data (betting history, platform usage patterns, preference settings).

2. How We Use Your Information

We use your information to: verify your identity and age as required by state gaming regulations; process deposits, wagers, and withdrawals; detect and prevent fraud, money laundering, and match manipulation; comply with state gaming authority reporting requirements; provide customer support; send you promotional offers and account communications (you may opt out of marketing at any time); improve our platform and user experience; and conduct responsible gaming monitoring.

3. Geolocation Data

BetMGM is required by law to confirm that you are physically located within a licensed jurisdiction before accepting any wager. We use geolocation technology for this purpose. Geolocation is active during your betting session and is not used to track your movements at other times. You must enable location permissions on your device to use the wagering features of our Platform. This data is processed in real time and is not retained beyond the requirements of applicable regulations.

4. Data Sharing & Disclosure

We do not sell your personal information to third-party data brokers. We share your information with: state gaming regulatory authorities as required by your jurisdiction's licensing terms; identity verification service providers; payment processors and financial institutions necessary to process your transactions; fraud detection and anti-money laundering service providers; and technology vendors operating under data processing agreements that prohibit secondary use. In the event of a merger, acquisition, or sale of assets, your information may be transferred to the successor entity, subject to the same privacy commitments.

5. Data Retention

BetMGM retains your personal data for as long as your account is active and for a period thereafter as required by applicable gaming and financial regulations. In most states, we are required to retain wagering transaction records and identity documentation for a minimum of five (5) years following account closure. After required retention periods, data is securely destroyed in accordance with our data lifecycle policy.

6. Your Privacy Rights

Depending on your state of residence, you may have rights under applicable privacy laws (including the California Consumer Privacy Act, Colorado Privacy Act, and similar state laws) to: access a copy of personal information we hold about you; correct inaccurate personal information; request deletion of your personal information (subject to legal retention requirements); opt out of targeted advertising; and receive a copy of your data in a portable format. 7. Security Measures

We employ industry-standard security controls including TLS 1.3 encryption for all data transmission, AES-256 encryption for data at rest, multi-factor authentication, continuous intrusion detection monitoring, and annual third-party security audits. Financial data is processed through PCI-DSS compliant systems. Despite these measures, no system is completely impervious to attack; in the event of a data breach affecting your rights, we will notify you in accordance with applicable state breach notification laws.

8. Cookies & Tracking Technologies

We use cookies and similar technologies for session management, fraud prevention, geolocation verification, and analytics. Essential cookies are required for platform functionality and cannot be disabled. Analytics and marketing cookies can be managed through your browser settings or our cookie preference center. BETMGM, LLC is committed to fostering a safe and responsible gambling environment. We recognize that while the vast majority of our customers enjoy sports betting as a form of entertainment, a small proportion may develop problematic gambling behaviors. We take this responsibility seriously and have implemented comprehensive measures to support all of our customers.

2. Age Verification

BetMGM strictly prohibits access to its Platform by individuals under 21 years of age. All new registrants undergo identity and age verification using third-party verification services cross-referencing government databases. Accounts where age cannot be confirmed will be suspended pending documentation review. We do not target marketing toward individuals under 21, and we support parental control software to prevent underage access to gambling websites and applications.

3. Problem Gambling Indicators

Recognizing problem gambling early is critical. The following behaviors may indicate a gambling problem: placing bets with money needed for essential expenses; borrowing money from family, friends, or financial institutions specifically to gamble; spending increasing amounts of time thinking about or placing bets; feeling anxious, irritable, or depressed when unable to gamble; failing to stop gambling despite repeated attempts; hiding gambling activities from family or friends; experiencing financial difficulties as a direct result of gambling; gambling to relieve stress, anxiety, or depression; and continuing to gamble despite negative consequences in personal, professional, or financial life. If you recognize any of these patterns in yourself or someone you know, please seek help immediately.

4. Available Player Tools

Deposit Limits: Users may set daily, weekly, or monthly deposit limits. Limit reductions are effective immediately. Limit increases require a mandatory 72-hour waiting period. Wager Limits: Maximum wager amounts can be set on a per-session or per-day basis. Loss Limits: Cap your maximum losses over a defined period. Session Time Limits: Receive automatic reminders after a set period of wagering activity. Reality Checks: Periodic on-screen notifications showing session duration and net wagering results. Cooling-Off Periods: Temporarily suspend your account for 24 hours to 6 months. Self-Exclusion: Permanently or temporarily exclude yourself from all BetMGM platforms for a minimum of 1 year.

5. State Self-Exclusion Programs

In addition to BetMGM's voluntary self-exclusion, all licensed states operate mandatory statewide self-exclusion registries. Individuals added to state registries are excluded from all licensed sports wagering operators in that state. BetMGM participates in all applicable state self-exclusion programs and uses regulatory-provided exclusion lists to screen for excluded individuals during account verification and ongoing account reviews. Attempting to circumvent a self-exclusion by using another person's identity is a criminal offense in most states.

7. Staff Training

All BetMGM customer service representatives receive mandatory responsible gaming training upon hiring and annual refresher certification. Staff are trained to identify behavioral indicators of problem gambling, respond with empathy, and direct affected customers to appropriate resources. Our responsible gaming team operates independently and has authority to initiate protective measures on any account displaying concerning behavior patterns, including mandatory breaks and outreach communications.
